4. The guest hereby agrees on behalf of himself and the members of his Party that it is a condition of his/their residence at the Cape Grace that neither the Cape Grace, its landlord, employees nor agents shall be responsible for any injury or death of any person or the loss or destruction of or damage to any property upon the premises, whether arising from fire, theft or any cause and by whomsoever caused or arising from the negligence or wrongful act of any person in the employment of the Cape Grace.

Covid-19

1. I understand that it is a criminal offence under South African law to misrepresent my COVID-19 status as well as to knowingly expose any person to the virus. By completing this screening questionnaire, I warrant that the information provided by me as to my COVID-19 status, any possible symptoms and/or known exposure is both true and correct to the best of my knowledge

2. I understand that Cape Grace Hotel (Pty) Ltd (“Cape Grace Hotel”) has implemented various measures to limit the spread of the COVID-19 virus. I acknowledge that I am required to adhere to the property’s procedures and protocols at all times, failing which Cape Grace Hotel reserves its rights in full to implement those reasonable and proportional measures as may be necessary to protect its guests, other patrons and staff from unnecessary exposure to COVID-19. I therefore have a responsibility to wear a mask while in public areas, to adhere to recommended social distancing practices and to practice safe respiratory etiquette.

3. Where a doctor or other duly authorised medical practitioner is called to Cape Grace Hotel to provide medical attention, I hereby consent to the disclosure of my COVID-19 status to the hotel’s staff and management on a need-to-know basis. I understand that any such services provided will be for my own account, and that I am bound by South African law to follow the instructions of such medical practitioner. I further understand that Cape Grace may, in its sole and absolute discretion, request that that a medical practitioner attend at the hotel to consult with me in instances where I present with 1 or more of the known COVID-19 symptoms.

4. Where I am subjected to isolation, quarantine or other precautionary measures at Cape Grace Hotel which serves to extend my stay at the property and/or requires that I am accommodated in a different room category, I acknowledge that any such additional expenses will be for my own account and the standard payment policies will apply on check-out.

5. While every effort has been made to ensure my safety, due to the contagious nature of the virus, I acknowledge that Cape Grace Hotel cannot guarantee that I will not become infected with COVID-19 during my stay. I understand that the risk of becoming exposed to and/or infected by COVID-19 may result from the actions, omissions or negligence of myself and others, including but not limited to Cape Grace Hotel employees and other guests and their families. In light of the aforementioned, I hereby release and agree to hold Cape Grace Hotel harmless from, and waive on behalf of myself, my estate, and any personal representatives, any and all causes of action, claims, demands, damages, special damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of the facility and/ or its employees and/ or agents, or that may otherwise arise in any way in connection with any services received from Cape Grace Hotel.

6. I understand that this release discharges Cape Grace Hotel from any liability or claim that I, my estate, or any personal representatives may have against the business with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from Cape Grace Hotel. This liability waiver and release extends to the business together with all owners, partners, members, agents and employees.

We highly recommend that guests obtain comprehensive travel insurance to cover a range of eventualities, including expenditure associated with extended stays at the property as a result of any mandatory COVID-19 quarantine or isolation, which may be in a  different room category subject to available capacity. We also advise that trip cancellation insurance is obtained to cover late cancellation fees and/or losses which fall outside of the hotel’s current COVID-19 policy – which policy is subject to change at the sole discretion of the hotel.
